This fact sheet explains the most important points about organic tin compounds in the Ministry of Environment's Statutory Order on limiting the sale and use of certain dangerous chemical substances and products for special purposes. Please note that only the rules in the Statutory Order apply, this fact sheet is merely a guide.
What is the scope of the legislation?
The legislation covers chemical substances and products containing organic tin compounds. These include paint, bottom paint for ships, and chemical substances and products used to treat industrial water.
What is the purpose of the legislation?The legislation is designed to limit the amount of organic tin compounds in the environment. For example, the compounds are released slowly from bottom paint on ships into the aquatic environment where they are toxic, even in very small concentrations. Releases are smaller when the organic tin compounds are chemically bound or polymerised with the other components in the paint.
What does the legislation say?
It is not permitted to market chemical substances and products containing organic tin compounds where the compounds act as biocides in paint or are not chemically bound or polymerised with the other components in the paint.
Furthermore, it is not permitted to sell or use chemical substances and products containing organic tin compounds which act as biocides in the treatment of:
• ship hulls less than 25 metres long,
• craft primarily used on lakes or rivers,
• Cages, floats and nets for sea farming or shellfish farming, and
• apparatus or equipment which is completely or partly submerged in water.
Sales of chemical substances and products containing organic tin compounds which act as biocides for other applications may only take place in packaging containing at least 20 kg, and only to commercial users.
The packaging must have the following text in an easy-to-read, indelible type:
"Må ikke anvendes på både med en totallængde på under 25 meter eller på både, uanset længde, som hovedsageligt anvendes på indre vandveje og søer, eller på nogen form for apparatur eller udstyr anvendt i havbrug eller skaldyrsbrug". "Forbeholdt erhvervsmæssige brugere". ("Must not be used on boats of less than 25 metres in length or on boats of any length which are primarily used on inland waterways and lakes, or on any form of apparatus or equipment used in sea farming or shellfish farming". "For commercial use only".).
It is not permitted to treat industrial water with chemical substances and products containing organic tin compounds.
Who is responsible?
Anyone selling or using chemical substances or products containing organic tin compounds is responsible for ensuring that the rules are complied with as they appear in the Statutory Order.
The EPA Chemical Inspection Service supervises the implementation of the legislation and is authorised to issue injunctions and bans. If the legislation is violated, this may lead to a fine or imprisonment.
