Does my product need authorisation?

In principle it will require authorisation to sell, import or use a product that acts as a biocide, i.e. controlling inter alia bacteria, algae or insects. The regulations are laid down in the Danish Chemicals Act and the Danish Pesticides Order, based upon the relevant EU legislation.

You should ask yourself a number of questions before placing such a product on the market.

Checklist

• Always be aware of the status of the active substance(s) within the EU. You can find the status on the Commission’s website or in the Danish Pesticides Order
  
• Check which active substances have been included and the deadlines for product applications in Annex 3 of the Pesticides Order
  
• Products containing non-included active substances must be phased out in accordance with the deadlines under EU provisions and Annex 4 of the Pesticides Order.
  
• Irrespective of their status in EU regulation all biocidal products in use in Denmark must be registered in the Danish Product Register via the Danish EPA, cf. Section 50 of the Pesticides Order.
